Through an ordinance signed since November 12 by Judge Léon Odimula Lofunguso and made public to date, the Council of State declared admissible and founded the request of the Free University of Kinshasa (ULK) which opposed the measure of Minister of ESU regarding his decision to ban recruitment into medical schools for certain establishments declared non-viable.
“The summary judge declared admissible and founded the request and, consequently, suspends with regard to the plaintiff the decision contained in the circular of the Minister of Higher and University Education prohibiting the recruitment of students in universities whose faculties of medicine are declared non-viable ”, one can read in this ordinance.
In this perspective, the same source which specifies that this order will be notified to the parties and published in the Official Journal of the DRC as well as in the Bulletin of decisions and publications of the jurisdictions of the Administrative Order, informs that the latter takes effect as of of its notification to the parties.
At the heart of heated disputes, this measure by the boss of higher and university education had been taken during the general states of higher and university education held at the University of Lubumbashi in Haut-Katanga.
At the end of this work, Minister Muhindo Nzangi had selected a total of 16 universities only deemed viable to organize the faculty of medicine across the country. According to him, this decision was not only the result of the Estates General but also of the results of the viability check that he carried out before the Estates General.
It should be noted that this decision of the Council of State is not general. It only concerns the Free University of Kinshasa.
